Airport Charges from March 26th, 2017

On 20th December 2016, the Ministry of Transport of the Czech Republic ruled that the published Price Matrix, including its parts and the way of their calculation, are not in breach of the provisions of Section 42e of the Civil Aviation Act (Ref. No.: 247/2016-LPR/8). On 21st December 2016, pursuant to Section 85, Art. 2, Letter c) in connection with the provisions of Section 74, Art. 1, the Administrative Procedure, the ruling of the Ministry of Transport became provisionally enforceable.

Thus, as at this day, the airport Price Matrix comes in effect and can be republished.

Based on the order by the Ministry of Transport, the Civil Aviation department, as the materially and locally competent administrative authority pursuant to Section 88, Art. 1, Letter c), point 2 of Act No. 49/1997, Coll., on Civil Aviation and on changes and amendments to Act No. 455/1991, Coll., on Trade (the Trade Act) as amended in connection with the provisions of Section 11, Art. 1, Letter e) of Act No. 500/2004, Coll., the Administrative Procedure as amended,

Prague Airport hereto announces that the published Airport Price List for the period from 26 March 2017 to 24 March 2018 is ineffective due to the opening of proceedings regarding the appeal by one of air carriers as to the Price Matrix, its parts and the way of their calculation compliance with the provisions of Section 42e and thus inapplicable by Prague Airport.

On September 7th, 2016, a public review of the Prague Airport’s proposed price matrix for the period commencing on March 26th, 2017 and ending on March 24th, 2018 was organised by Prague Airport and attended by representatives of air carriers which, pursuant to the respective provisions of Article 42f of the Act No. 49/1997, Coll. about Civil Aviation as amended and amendments and addenda to the Act No. 455/1991, Coll. about Trade (the Trade Act) as amended, had confirmed their attendance in writing prior to the meeting and provided the airport operator with all legally required data. The following comments regarding the reviewed Price List were made by the respective air carries and took under consideration by the airport operator:

Representatives of air carriers and IATA suggested the possibility of achieving better operational results than planned, which will result in increased aviation business revenue. 
Based on the information received from the airport operating air carriers during following negotiations and on their confirmed increased operations in 2017, Prague Airport updated its operational result plan in October 2016. As a result of the update, a slight increase of the number of passengers handled in 2017 has been projected with a year-on-year increase of 4.66%. This increase supports a change of the airport price list in the category of the Departing Passenger Service Charge, which most significantly impacts the overall aviation business revenue. The Departing Passenger Service Charge has thus been lowered from the originally proposed CZK 585 to the final CZK 580.

Air France-KLM requested specification of the new rate for night parking on OPS contact stands.
This rate includes the use of passenger boarding bridge/bridges on arrival and departure + air conditioning/heating. The specification of conditions was implemented into the final price list.

Lufthansa Group proposed to shorten the period of maximum use of the passenger boarding bridges from 120 minutes to 60 minutes.
Charges for the use of boarding bridges are set for each action (bridge movement) based on the allocated costs. The limit of 120 minutes is only a maximum period of use for this price (for aircraft with MTOW up to 100 t) to avoid misuse of this infrastructure. The vast majority of flights use the bridge within shorter period and they are all charged the same price. Shortening of the maximum period of bridge use does not represent any significant changes in revenues that would affect the calculation of this category of charges. These charges will thus remain unchanged.

On October 27th, 2016, Prague Airport published the airport Price List for the operational period commencing on March 26th, 2017 and ending on March 24th, 2018. The Price List is now available for download in Portable Document Format at Prague Airport’s website under the Business section (see below).

Dne 20. 12. 2016 Ministerstvo dopravy vydalo rozhodnutí, že zveřejněný letištní ceník, jeho složky a způsob jejich stanovení nejsou v rozporu s ustanovením § 42e zákona o civilním letectví (č.j. 247/2016-LPR/8). Dne 21. 12. 2016 se stalo v souladu s ustanovením § 85 odst. 2 písm. c) ve spojení s ustanovením § 74 odst. 1 správního řádu rozhodnutí Ministerstva dopravy předběžně vykonatelné,

tudíž tímto dnem je letištní ceník v účinnosti a lze jej opětovně publikovat.

Na základě příkazu Ministerstva dopravy – odboru civilního letectví jako věcně a místně příslušného správního orgánu dle ustanovení § 88 odst. 1. písm. c) bod 2. zákona č. 49/1997 Sb., o civilním letectví a o změně a doplnění zákona č. 455/1991 Sb., o živnostenském podnikání (živnostenský zákon), ve znění pozdějších předpisů, ve spojení s ustanovením § 11 odst. 1 písm. e) zákona č. 500/2004 Sb., správní řád, ve znění pozdějších předpisů,

oznamuje Letiště Praha, a.s., že uveřejněný Letištní ceník pro období 26. března 2017 do 24. března 2018 je z důvodu zahájeného řízení o žádosti jednoho z leteckých dopravců, zda zveřejněný letištní ceník, jeho složky nebo způsob jejich stanovení není v rozporu s ustanovením § 42e, neúčinný, tudíž nemůže být ze strany Letiště Praha aplikován.

Dne 7. 9. 2016 proběhlo veřejné projednání letištního ceníku pro období 26. 3. 2017 až 24. 3. 2018 za přítomnosti zástupců leteckých dopravců, kteří se v souladu s § 42 f Zákona č. 49/1997 Sb., o civilním letectví a se změnou a doplněním Zákona č. 455/1991 Sb., o živnostenském podnikání (živnostenský zákon), ve znění pozdějších předpisů, přihlásili k účasti na projednávání návrhu ceny za užívání letiště a sdělili provozovateli letiště zákonem požadované údaje. Ze strany těchto dopravců byly vzneseny následující připomínky k diskutovanému návrhu letištního ceníku, které byly provozovatelem letiště zohledněny následovně:

Zástupci leteckých dopravců a IATA upozornili na možnost dosažení vyšších než plánovaných provozních výkonů s dopadem na zvýšení výnosů z letecké činnosti.
Letiště Praha, a.s. v závislosti na informacích získaných od operujících leteckých dopravců během následujících jednání a na potvrzeném navýšení provozu na rok 2017 provedlo v říjnu 2016 aktualizaci plánu provozních výkonů. Výsledkem této aktualizace je mírné zvýšení prognózy počtu cestujících v roce 2017 na meziroční růst o 4,66%. Toto zvýšení umožňuje úpravu letištního ceníku v kategorii poplatku za odlétajícího cestujícího, která nejvíce ovlivňuje celkovou výši výnosů z letecké činnosti. Sazba poplatku za odlétajícího cestujícího tak byla snížena z původně navrhovaných 585 Kč na konečných 580 Kč.

Air France-KLM požádala o upřesnění podmínek nové sazby pro noční parkování letadel na kontaktních stáních OPS.
Tato sazba zahrnuje použití nástupního mostu/mostů na příletu a odletu včetně klimatizace. Upřesnění podmínky bylo doplněno do finální verze letištního ceníku.

Lufthansa Group navrhla zkrácení času maximálního využití nástupních mostů ze 120 minut na 60 minut.
Poplatky za využití nástupních mostů jsou stanoveny za každou akci (pohyb mostu) v závislosti na alokovaných nákladech. Limit 120 minut je pouze maximální možnou dobou využití za tuto cenu (v případě letadel s MTOW nižší než 100 t) z důvodu, aby nedocházelo k neefektivnímu využívání této infrastruktury. Většina letů využívá nástupní mosty v kratším časovém období a je jim účtována shodná cena. Zkrácení maximální doby využití by tak nemělo významnější vliv na změnu výnosů a dopad na kalkulaci této kategorie poplatků. Příslušné poplatky tedy zůstávají beze změny.
